These Ticketholder Terms and Conditions/Terms and Conditions of Event Attendance (the “Terms and Conditions”) will apply to all ticketholders or other individuals (in each case, an “Attendee”) attending events established, operated, overseen, or marketed by Ampersand Creative LLC or any one or more of its affiliates (in each case an “Event” and collectively the “Events”).
By purchasing a ticket to or otherwise attending any one or more of the Events, the Attendee unconditionally and irrevocably accepts and agrees to be bound by these Terms and Conditions.
1. Refund policy. Refunds shall not be issued for any reason. If an Event is postponed for any reason, tickets will be valid for any postponement date.
2. Changing your ticket. Tickets are transferable via Eventbrite's platform to other people, but are non-refundable and cannot be exchanged for other time slots, days, or for future Events.
3. Code of Conduct. Disrespectful, offensive, unsafe, disorderly, unlawful, hostile, abusive, threatening, inciting, antagonizing, and/or intimidating behavior will not be tolerated. Any Attendee who displays such behavior, in the sole and absolute discretion of Ampersand Creative LLC, shall be subject to denial of entry to or immediate removal from an Event and the hosting premises without a refund.
4. Rules and Regulations. Ampersand Creative LLC may enact and enforce rules and regulations for any Event prior to and/or during the Event. Attendees shall abide by and comply with any posted signs or other displays concerning rules and regulations, including but not limited to those regarding personal conduct, health and safety, trash disposal and recycling, and compliance with laws.
5. Children and Pets. Children under the age of 4 may attend an Event with an adult without purchase of a ticket. Children age 4 and older require a ticket. All children attending an Event must be accompanied by an adult at all times. Pets are not allowed at any Events. Property trained and certified service animals are permitted in the company of its/their owner/handler.
6. Alcohol. Only Attendees over the age of 21 will be served alcohol at an Event. All Attendees being served alcohol will be required to provide a valid government-issued non-expired form of photo identification prior to alcohol service, regardless of the Attendees age or appearance. Ampersand Creative LLC and each of its vendors reserves the right to cut off alcohol service to any Attendee for any reason in its/their sole and absolute discretion.
7. Credit Card Chargebacks. Any Attendee who, after purchasing a ticket and attending an Event, causes its credit card provider to reverse the ticket-purchasing transaction, shall be denied attendance to any future Event, regardless of whether said Attendee purchases a ticket in advance.
8. Indemnification. Each Attendee will indemnify and hold harmless Ampersand Creative LLC and its principals from and against any and all liabilities, obligations, damages, losses, fees, claims, costs, and expenses, including reasonable attorneys’ fees, which are incurred by or asserted against Ampersand Creative LLC by reason of any of the following: (a) such Attendee’s failure to comply with these Terms and Conditions; and (b) any acts or omissions of Attendee at or concerning the Event, including but not limited to any acts or omissions causing personal injury or property damage at the Event.
By attending an Event, you are assuming certain risks inherent in food consumption, including specifically as to individuals with gluten intolerances or other dietary restrictions. In consideration of your admission to the Event, and by attending the Event, you are agreeing as follows:
1. The Event host, Ampersand Creative LLC (the “Host”), is not responsible for any of the preparation, storage, shipment, sale, or service of any food, beverage, or other consumable products offered at the Event. By attending the Event, you agree to release and hold harmless the Host and its members, managers, and affiliates from and against any claims relating to food or beverage consumption at the Event, including but not limited to claims related to medical bills or otherwise related to personal illness, injury, exacerbation of existing medical conditions, or death.
2. Attendance at the Event is voluntary. While the Host requires that all vendors agree to sell and serve only 100% gluten-free consumable products, it is impossible to guaranty that there will be no gluten present in any product offered at the Event. If you suffer from a medical condition, allergy, food sensitivity, or other affliction which is exacerbated, worsened, or triggered by the consumption or presence of gluten, you are advised to consult a medical professional before attending the Event. In any case, if you choose to attend the Event, you are doing so at your own risk.
3. If you to choose to attend the Event, you assume all risks associated with the consumption of any products offered at the Event, known and unknown, foreseeable and unforeseeable, and you accept full responsibility for any medical bills, personal illness, injury, exacerbation of existing medical conditions, or death caused by or arising out of your attendance at the Event and/or consumption of any products offered at the Event.
